Circle Rewards Loyalty Program Terms and Conditions

Circle Rewards is a digital loyalty program managed by Village Market Mall. Members of the program can enjoy benefits and earn points which are redeemable for rewards at the Mall and/or participating corporates. The Program is accessible only via the Circle Rewards mobile application, where users must create an account.

By participating, Members agree to the Programme's Terms and Conditions, including future amendments by the Mall. The Mall may accept or reject any applicant at its discretion without explanation. Creating an account signifies acknowledgement and acceptance of the App's Terms of Use, Privacy Policy and consent to data collection and processing.

1. Membership & Eligibility

i. Participation in the Circle Rewards Loyalty Program is generally open to individuals aged 18 years and above. However, individuals aged between 13 and 17 years may participate under the following conditions:

a. Parental Consent
Minors may only join the Program through a referral initiated by a parent or legal guardian. By referring the minor, the parent or guardian provides verifiable consent and agrees to these Terms and Conditions, assuming full responsibility for the minor's participation.

b. Limited Participation
Minors may have restricted access to certain benefits or rewards and may not enter into any binding obligations under this Program.

c. Data Protection
Any personal data collected from minors will be processed in accordance with the Data Protection Act, 2019 and only with the express consent of a parent or legal guardian.

d. For participants under the age of 18, the registration process must be initiated by a parent or legal guardian through our secure referral system. The minor may only participate in the Program once the referral has been submitted, the consent process completed and verification confirmed.

ii. Each Member receives a unique, non-transferable account. Multiple accounts, submitting others' receipts, or using others' rewards is prohibited and may result in termination of the Member's account and forfeiture of all points accrued.

iii. Circle Rewards may merge or terminate duplicate accounts and is not liable for any loss of privileges and benefits from such actions.

iv. During registration, applicants must provide their name, email and registered mobile number as the minimum requirements. There may be additional information that will be required from time to time.

v. Members must keep their information accurate and current. Providing false information can lead to suspension, termination and/or less privileges and benefits.

vi. Membership starts upon activation and follows through the subsistence of the contract or unless Circle Rewards sets an expiry date or cancels it without liability.

vii. Circle Rewards reserves the right to terminate or discontinue to program in its entirety, and will give Members advance notice of the same via email to allow them to redeem any accrued points.

viii. To terminate membership, written notice must be provided to Circle Rewards. Upon termination, all Points are forfeited.

ix. Breaching the Terms or abusing Programme rights can result in legal action, membership termination and loss of privileges, with offenders potentially being blacklisted.

x. Members must report any issues with the App as soon as possible, including where the same may have been accessed by a third person or lost / stolen. Circle Rewards will not be held responsible or liable in any way for any losses or usage that may result from the above.

2. Earning and Redeeming Points

i. Points cannot be exchanged for cash.

ii. Points are awarded based on the net purchase value after discounts. There are limits on the number of points that can be earned.

iii. Misuse, such as submitting exchange receipts, or accrual of points by an unauthorised person can lead to investigation and membership termination as well as loss of all points accrued.

iv. Points from returns or refunds can be voided by Tenant and/or Circle Rewards without notice.

v. Defective or non-compliant receipts may result in no Points being credited.

vi. Points will expire after 12 months of dormancy from the date of the last transaction. Following the lapse of the 12-month period, there will be a further grace period of 3 months during which we will send email notifications to remind the member of the impending expiration. If the points are not utilized within this grace period, the customer will permanently lose the points.

vii. Base earning scheme is Kshs. 100 is equivalent to 1 point.

viii. Points balance can be checked through the App.

ix. Participating outlets are outlined in the App. Participation amongst the outlets may vary, and the participating outlet reserves the right to exclude any items or services on sale or on promotion from the Loyalty Program.

3. Intellectual Property

i. No license or right to use any trademarks related to the Programme is granted without written permission.

4. No Representations or Warranties

i. Information in the App is provided "as is" without warranties of any kind.

ii. Circle Rewards does not guarantee the accuracy, security, or uninterrupted access to the App and Programme.

5. Exclusion of Liability

i. Circle Rewards is not liable for any damages or losses howsoever caused related to the use of the App and Programme.

ii. Liability exclusions cover acts of employees, system failures, (including third party systems) service interruptions (internal as well as external), and data breaches.

6. Indemnity

i. Members agree to indemnify and hold harmless Circle Rewards for any damages, losses, or costs howsoever incurred, including as a result of their actions or breaches of these Terms and Conditions.

7. Data Collection

i. Data related to transactions and App usage may be collected for operation, marketing, and analysis purposes.

ii. Members consent to their data being collected, used and disclosed as per the Privacy Policy.

8. Discretion of Circle Rewards

i. Circle Rewards reserves the right to amend or cancel any part of the Programme at its discretion without liability.

ii. Circle Rewards reserves the right to amend these Terms and Conditions at its discretion, and where this right is exercised, the Members will be notified via the App or may receive the amended version via email. Any subsequent use of the App will be deemed to be acceptance of the amended Terms and Conditions.

iii. Circle Rewards reserves the right to terminate any membership in instances of attempted or actual abuse of the Programme, or upon any suspicion of fraud or dishonesty, or if any use is made or attempted to be made by another person.

iv. Decisions regarding the Programme are final and binding on Members.

9. Addition of New Partners

We reserve the right, at our sole discretion and without prior notice, to add new partners to the Loyalty Program from time to time. Benefits, rewards, or offers available through such partners may be subject to separate terms and conditions. Participation by new partners may enhance or alter the ways in which loyalty points or rewards can be earned or redeemed.

10. Referral Limits and Activation of Benefits

Participants in the Referral Program may refer up to a maximum of ten (10) individuals. Referral benefits or rewards will only be activated once the referred individual completes a qualifying transaction, as defined by us. No benefits shall be provided for referrals that do not result in a completed transaction. We reserve the right to verify all referrals and transactions before applying any referral-related benefits.
